These Terms of Service (“Terms”) govern your access to and use of Locksmith’s websites, dashboard, APIs, and related services (collectively, the “Services”) offered by Locksmith (“we”, “us”). By using the Services, you agree to these Terms.
1. Account and eligibility
You must provide accurate registration information and safeguard your credentials. You are responsible for all activity under your account. You may use the Services only in compliance with applicable law and our acceptable use expectations described below.
2. The Services
We grant you a non-exclusive, non-transferable right to access and use the Services during your subscription or free tier, subject to these Terms and your plan limits. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
3. Customer data
You retain ownership of data you submit. You instruct us to process it to provide the Services. You are responsible for your end users and for providing any required notices and consents. Details on how we handle personal data are described in our Privacy Policy.
4. Acceptable use
You will not misuse the Services, including by attempting to breach security, overload our systems, send unsolicited bulk email in violation of law, or use the Services for unlawful, fraudulent, or harmful activity. We may suspend access for violations.
5. Fees and taxes
Paid plans are billed according to the pricing shown at checkout. Unless stated otherwise, fees are exclusive of taxes, which you are responsible for where applicable.
6. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED DOLLARS (USD $100) IF YOU HAVE NOT PAID FEES.
8. Term and termination
You may stop using the Services at any time. We may terminate or suspend access for breach, risk, or legal requirements. Provisions that by their nature should survive will survive termination.
9. General
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules. If a provision is unenforceable, the remainder stays in effect. These Terms are the entire agreement regarding the Services and supersede prior oral or written understandings on the same subject.
